However, in this process, many environmental risks have emerged, including the widespread problem of land destruction. China’s current legal system which regulates the land destruction behavior in exploiting mineral resources upholds a kind of system concept and path called “regulation mode,” which is reflected in the idea dominated by executive power to allocate land use right needed by exercising mining rights, and in the main means of administrative supervision to resolve the land destruction caused by the exploitation of mineral resources. The system operation under the regulation mode will produce many problems. It will lead to the failure of current system regulating the environmental risks caused by exploiting shale gas. Meanwhile, it is difficult to fully protect and relief the land interests of many types of rights holders on the mining area land. In order to solve the plight of current system, the key is to achieve the updating from the regulation mode to the interaction mode from the levels of system type and system content, and more application to Tort Law to address the land destruction disputesin the exercise of mining rights.
