  • 三新促三质:数字化转型赋能银行主动风险承担能力的新质生产力机制

As a core manifestation of financial new quality productive forces, banks' digital transformation plays a pivotal role in promoting high-quality financial development. However, few studies carry out systematic theoretical exploration of developing new quality productive forces “tailored to the financial context”, and the mechanisms through which digital transformation enhances banks' proactive risk-taking capability in the framework of financial new quality productive forces remain understudied and warrant in-depth investigation.This study constructs a theoretical framework for financial new quality productive forces, dissecting its “novel” and “qualitative” attributes. It posits that financial new quality productive forces refer to productive forces centered on new production factors (e.g., data), anchored in new business models (e.g., fintech-enabled services), and oriented toward new industrial formats (e.g., digital finance ecosystems), characterized by high quality, premium performance, and efficient productivity. Using panel data from listed banks in China from 2010 to 2021, this study conducts theoretical and empirical analyses to examine whether banks' digital transformation achieves “quality improvement through novel drivers” and explores its impact mechanisms on proactive risk-taking in this framework. The findings reveal that digital transformation, an essential pathway for developing financial new quality productive forces, enhances proactive risk-taking by expanding human capital scale (new production factors), reducing operational costs (new business models), and fostering industrial competition (new industrial formats), thereby realizing the “novelty-driven quality improvement” hypothesis. Additionally, our analysis of governmental economic regulation uncovers synergistic effects between digital transformation and market liberalization. As financial regulatory intensity increases, the impact of digital transformation on proactive risk-taking evolves in a phased manner: prioritizing speed enhancement initially, followed by structural and scale optimization. Conversely, with strengthened support for innovation and technology, the effect trajectory shifts to first optimizing structural and scale dimensions before accelerating risk-taking momentum.This study makes the following contributions. First, it extends the concept of new quality productive forces to the financial domain, clarifying the relation between digital transformation and financial new quality productive forces and enriching its theoretical underpinnings. Second, by examining transmission pathways through the three dimensions of new production factors, business models, and industrial formats, and characterizing proactive risk-taking across structural, scale, and velocity dimensions, it provides a holistic framework for identifying risk-taking behaviors in the context of digital transformation, thereby unraveling their intricate mechanisms. Third, it investigates the dynamic moderating roles of governmental functions (economic regulation, regulatory oversight, and innovation-driven policies) in shaping the risk-enhancing effects of digital transformation, offering insights into the interplay between state intervention and market innovation in financial development.By uncovering the intrinsic logic between digital transformation (embodied in financial new quality productive forces) and high-quality bank risk management, this study not only facilitates banks' efficient digital transformation and the development of financial new quality productive forces but also enables government agencies to implement more scientific macroregulation and enhance their macro governance capabilities.   • 数字经济何以赋能新质生产力:基于生产关系理论与双重机器学习模型

However, existing studies mostly focus on the perspectives of technological application or industrial development, and there is still a lack of systematic research on how the digital economy affects new quality productive forces through changes in production relations, especially in terms of in-depth analysis of regional heterogeneity and mechanisms of action.Based on the theory of production relations, this paper selects panel data from 282 prefecture-level cities in China from 2011 to 2022 and employs the double machine learning model to explore the mechanism by which the digital economy empowers new quality productive forces in cities. The study finds that the digital economy can empower the development of new quality productive forces in cities, with the most significant impact on new-form objects of labor. The regional heterogeneity analysis reveals that the impact of the digital economy on new quality productive forces varies across regions, with the degree of influence decreasing in the following order: eastern region, western region, central region, and northeastern region. Additionally, in cities with higher levels of economic development, the digital economy exerts a stronger promoting effect on new quality productive forces. Among cities with different resource endowments, the magnitude of influence follows this sequence: regenerative cities, growing cities, declining cities, non-resource-based cities, and mature cities. The mechanism test results indicate that the digital economy empowers the level of new quality productive forces in cities through mechanisms such as optimizing factor allocation and promoting industrial structure transformation.Compared with previous studies, this paper makes threefold contributions: First, it constructs a scientific and rational index system from the perspective of production relations theory to measure new quality productive forces, providing a new perspective for the study of new quality productive forces. Second, it systematically analyzes the impact pathways of the digital economy on new quality productive forces and identifies heterogeneous effects across different regions, filling the gap in existing research. Third, it introduces the double machine learning model to effectively address estimation biases and model instability in high-dimensional data environments, enhancing the robustness of causal inference.This study not only enriches the theoretical research on the digital economy and high-quality urban development but also provides a scientific basis for local governments to formulate more targeted regional development policies in the digital economy era. Existing research primarily focuses on how platforms' copyright protection technical measures affect fair use systems, while overlooking their impact on users' intellectual privacy. This paper systematically examines the tension and coordination mechanisms between platform copyright protection measures and users' intellectual privacy.This paper adopts a theoretical analysis and takes Professor Richards' “intellectual privacy” theory as the core framework. Combined with domestic and international data and privacy protection theories, this paper explores the jurisprudential foundation of intellectual privacy protection in China and analyzes its rights structure. This paper argues that intellectual privacy, as the right of individuals not to be monitored or interfered with during intellectual exploration, possesses a composite legal interest structure: It is not only a derivative safeguard for freedom of speech but also embodies attributes of both privacy rights and personal information rights. Under the copyright supremacy, platform technical measures infringe upon intellectual privacy through three dimensions: continuous monitoring causing legal flaws; AI technology intervention creating derivative risks; and automated enforcement leading to remedy imbalance. These conflicts stem from the “bias” in copyright law's internal rules and platform power expansion. Platforms achieve power ascendancy and transform into “quasi-sovereigns” in digital space by leveraging technological advantages, bargaining power, dominant positions, and procedural exemptions.Based on the “nested protection” theory of intellectual privacy, this paper proposes constructing an intellectual privacy-friendly collaborative governance framework. First, it is necessary to establish a hierarchical rule system to limit the excessive expansion of technical measures, formulate tiered protection rules for intellectual privacy, and improve rapid complaint-handling mechanisms. Second, it is necessary to embed intellectual privacy protection concepts into technical architecture, design privacy-first default rules, and introduce technologies such as zero-knowledge proofs and privacy computing to support user-controlled data management. Third, it is necessary to establish a cross-departmental joint regulatory mechanism led by the Cyberspace Administration of China, implementing a “substance over form” regulatory philosophy covering the entire technology lifecycle. This paper breaks through the previous neglect of intellectual privacy rights, proposes a composite rights structure and nested protection model for intellectual privacy, and provides an in-depth analysis of how AI-empowered platforms erode intellectual privacy. Given that the current AI-generated objects are mostly expressed in the form of literary and artistic works, and cultural diversity is the ultimate goal of copyright legislation, cultural diversity is a logical perspective for arguing whether AI-generated objects can obtain copyright protection. When analyzing it from this logical perspective, it is possible to identify a lack of culturality in AI-generated objects that rely solely on human input of cue words.By describing the mechanism of operation of the internal mechanism of copyright law, this article clarifies that copyright protection and public domain retention, as well as the state of balance between the two, are aimed at ensuring the realization of cultural diversity. Using this as a basis, the article analyzes how AI-generated objects that rely solely on the input of cue words can lead to a cultural diversity crisis. AI is controlled by humans and absorbs limited data, so it lacks the ability to innovate culturally. AI is unable to generate “Gdel information” unique to the human brain and lacks the input of human emotions, so AI-generated objects lose their humanistic significance. The homogenization and pervasiveness of the content of AI-generated objects, the speculative behavior that can easily be triggered by the low cost of creation, and the fact that AI is being developed to improve human life rather than to replace human creativity, mean that AI-generated objects are unable to stimulate cultural output. The act of inputting prompt words is closer to the labor in the “labor/creation dichotomy”. Only when humans use AI as a tool and are deeply involved in the process of producing AI-generated objects is there a need for copyright law protection; otherwise, AI-generated objects should all go into the public domain.This article expands previous literature in the following aspects. First, retracing back to the value level of copyright law, this article deeply analyzes the deviation from the value of cultural diversity of AI-generated objects by inputting prompt words from the perspective of the realization of cultural diversity, in terms of cultural innovation ability, cultural innovation power, and humanistic and emotional value. Second, using the ordinary user who enters the prompt word as an entry point, it divides into professional creators who are deeply involved in the process of outputting AI-generated objects, and the latter should be the focus of copyright law protection in comparison to the other.Based on the ultimate value of cultural diversity pursued by copyright law, this article discusses in detail how AI-generated objects have triggered the crisis of cultural diversity and clarifies the status of AI-generated objects in copyright law at the level of legal value. In the contemporary era, digital media technologies are increasingly permeating human life, with smartphones serving as the intermediary connecting humans to the world. This phenomenon has sparked reflections on the mode of digital existence and given rise to digital minimalism.This paper delves into the practical measures of digital minimalism from the perspective of Marxist proletarian consciousness, employing the grounded theory methodology for research. It specifically addresses the following three questions: What commonalities exist between digital minimalism and Marxist proletarian consciousness? In what ways do they differ? How should the essence of digital minimalism be defined? The paper reveals the following findings: Firstly, digital minimalism's rejection of the repression of self-awareness and the alienated mode of production and life in capitalist society aligns with Marxism's critique of capitalism. Digital minimalism embodies certain characteristics of Marxist proletarian consciousness, sharing similar practical goals and methodological approaches. Secondly, digital minimalism seeks to reclaim “subjectivity” within the digital realm, which may otherwise be dominated by capital. However, constrained by real-life circumstances, it opts for “going offline” to evade capitalist domination, severing the material connections between the virtual and real worlds to avoid the “usurpation” of human labor by intelligent creations. Lastly, digital minimalism neither formulates a unified mode of life in the digital world nor constitutes a direct confrontation with capitalism. Moreover, its acts of resistance against digital capital do not exhibit thoroughness but oscillate between evasion and acceptance. This necessitates the awakening of proletarian consciousness to dispel digital minimalism's tendency to evade the production and lifestyle of digital capitalism, and elevate digital minimalism's critique of it through practical engagement.Digital minimalism still explores the interactive relationship between humans and digital technologies. Compared to previous literature, this paper makes advancements in two aspects: Firstly, it investigates the logical connections between digital minimalism as a new form of social consciousness and Marxist proletarian consciousness, thereby expanding prior research on reflections on and subjective rejections of digital technology applications from a novel perspective. Secondly, in contrast to merely defining digital minimalism, this paper endeavors to provide a reasonable interpretation of digital minimalism practically and theoretically, such as its intrinsic causes and dynamic evolutionary trajectory. Consequently, this paper aims to focus on Marx's proletarian consciousness, elucidate the historical causes of the shift in the human-technology interaction inherent in digital minimalism, and explore how digital minimalism transitions from reliance on digital technologies to a path of subjective rejection and resistance.Rooted in Marxist proletarian consciousness, this paper endeavors to elucidate the social relational structures embedded in digital minimalism and the human-technology interactions influenced by them from the perspectives of intrinsic causes and historical shifts. This study aims to explore how the Global South challenges Western-centric paradigms and constructs a diversified communication order through theoretical and practical innovations in journalism. Drawing on a trans-domain analytical method, this study incorporates Geertz's theory of thick description and a postcolonial perspective to conduct a systematic comparative analysis of journalism practices in Latin America, Africa, the Arab world, and Asia. The analysis focuses on four key dimensions: political-economic structures and power relations; cultural ethics and historical contexts; the empowerment and limitations of digital technologies; and decolonization and social mobilization strategies.The study finds that journalism practices in the Global South not only challenge Western-centric theoretical frameworks but also promote a pluralistic and decolonial transformation of journalism ontology. Currently, journalism in the Global South exhibits three common features: First, it critiques concepts like “objectivity” and “neutrality” through decolonial knowledge production; Second, it proposes a “knowledge counterflow” mechanism to elevate local Southern experiences into universal theoretical insights; Third, it incorporates the logic of the “mass line” into journalism's ontological structure, enhancing its function as an agent of social change.At the regional level, this study reveals differentiated practices. Latin American journalism redefines the social responsibility of journalism through decolonial practices, particularly as digital-native media in Mexico and Venezuela adopt community participation and anti-inequality positions to form hybrid (mestizaje) journalism models. African journalism emphasizes community and social welfare through the ethics of Ubuntu, producing a culturally distinct orientation that contrasts with the Western emphasis on critical distance. Arab digital media, by circumventing traditional censorship, build new forms of public dialogue, and digital empowerment enables the creation of regionally independent discursive spaces. Asian journalism emphasizes collectivism and social harmony, integrating journalism with social governance through the mass line. For instance, Chinese media highlight journalism's role in social integration; Indonesian Muslim journalists uphold justice, fairness, and responsibility as core values; while Thai media coverage tends to de-emphasize conflict and focus on community impact. Additionally, in the era of intelligent media, while digital empowerment offers new opportunities for Southern countries, the risks of digital colonialism persist. In response, Global South nations must adopt proactive strategies concerning Internet governance, data sovereignty, and algorithmic transparency.This study's theoretical innovations include the introduction of the “knowledge counterflow” concept to explain the reverse contributions of Southern theories to the global knowledge system; the incorporation of the mass line into the ontological framework of journalism, thereby enriching journalism's social functions; and the articulation of the academic vision of “the South as the World”, which transcends the unidirectional, technology-assistance model of development communication. Global South journalism does not reject Western concepts wholesale, but rather recontextualizes and localizes them, developing indigenous theories such as “contextual objectivity” to better align journalism with specific sociocultural settings. These theoretical and practical innovations provide vital intellectual resources for constructing a pluralistic communication order and a shared future for humanity, offering significant policy insights for global communication governance in the digital-intelligent era. Biological life is gradually evolving towards a digital and cross-temporal eternal state. “AI Revival”, based on the capture, analysis, and automatic generation of big data through generative artificial intelligence technology, simulates the individual's discourse expression style with large language models to achieve the “revival” of deceased lives. Based on this, media technology achieves a structural reshaping of biological life that transcends the boundaries of life and death in time and space. However, this mediated life phenomenon, based on nostalgia and remembrance as its emotional foundation, has formed an industrial chain aimed at the “resurrection” of life, which is manipulating and arranging the digital lives of individuals.“Life power” was proposed by Foucault during his examination of the development process of “governance techniques” in modern Western society. It reflects the interactive relationship between individual biological life and social development. The essence of “life power” is the power to take responsibility for life, for the physiological processes of human beings as a category, and guarantee a regulatory power within them. This power operates on factors such as the birth rate, death rate, and lifespan. This paper explores the changes in the operation mechanism of “life power” in the intelligent era by introducing Foucault's view of knowledge power, and analyzes the operation characteristics, causes, and risks of digital life power with the goal of “life revival”.This paper finds that the AI “revival” technology enables individual lives to be produced in accordance with the temporal logic of material production-spiritual production-population production on the Internet platform, based on individual data production, and through the three-pole operation mechanism of “cultivation-adjustment-placement”. It has developed the two-pole operation mechanism of “domestication-regulation” in Foucault's “life power” operation. In the era of digital existence, power is increasingly operating in the form of communication, and its de-physicalization feature is becoming more and more obvious. In recent years, the collection of data by platforms has provided a foundation for the production of individual virtual “second bodies”. The production of individual data in all time and space is constantly improving the manifestation form of the “second body”. This process not only satisfies individuals' imagination of “digital immortality” but also meets the control of digital life by digital platforms. Furthermore, the production of individual “residual data” based on the “second physical body” is becoming an important basis for the ranking of users' digital life levels, influencing the life forms and order that individuals can “resurrect” and has become an important value basis in the life “resurrection” industrial chain.This paper reveals the evolution logic of the operation mechanism of “life power” by AI technology. The AI “revival” technology is reconstructing the human life hierarchy by ranking the value of individual “residual data”, and establishing a control set for the entire human life that transcends time, space, and the boundary between life and death. The reshaping of life processes by AI technology is eroding the significance of the body, death, and even subjectivity to life, transforming individuals into production machines of their own digital lives. However, existing research often overlooks the inherent correlation and logical verification between semantic connotations and discourse relevance, as well as syntactic distributions. This article, based on the theory of semantic grammar, uses the Modern Chinese Corpus of the Center for Chinese Linguistics (CCL) at Peking University as the corpus source. According to the logical order from macro to micro, it combines positive description with negative verification and extracts its semantic connotation.Firstly, discourse relevance includes two aspects: logic and semantics. In terms of logic, it is in the result sentence of generalized causal association. It is worth noting that its causal association is not an inevitable inference judgment, but a stimulating emotional response. Therefore, causal conjunctions with inference are less commonly used in compound sentences. In terms of semantics, emotions play a bridging role, and the semantic relevance corresponding to causality is as follows: the immediate perceptible and non-expectable reasons-subject emotions-emotional reactions (cognitive thinking, emotional expression, physical actions, and speech acts). Bujin can be found in both subject emotional sentences and emotional response sentences.Secondly, from the perspective of causes, not all reasons can lead to bujin. Stimulating reasons must have the immediate perceptible and non-expectable characteristics. The immediate perceptible refers to the behavior subject perceiving situational stimuli through sensation and perception. Non-expectable refers to the behavior of the subject not expecting the occurrence of a cause, or the sudden occurrence of a cause beyond their expectations, so the cause can be either “no expecting” or “unexpected”.Finally, from the perspective of results, the sentence type, predicate, and semantic connotation are all constrained by emotions. (1) In terms of sentence type, affirmative declarative sentences are mainly chosen. (2) In terms of predicate, based on the relationship between predicates and emotions, subsequent predicates can be divided into indicating and expressing emotional predicates. Indicating emotional predicates directly indicate the emotional type of the behavioral subject and the resulting psychological reactions, including emotional and psychological adjectives. Expressing emotional predicates display the emotions of the subject through behavioral reactions, including verbal, actions, thinking, and emotional verbs. (3) The semantic connotation includes the directness of the stimulus cause and the non-proactivity of the response result, which can be confirmed by the verb-like structure of the cause sentence, the conjunctions and prepositions of the result sentence in terms of language form. Bujin means that “the immediate perceptible and non-expectable reasons stimulate the non-initiative emotions and emotional responses of the behavior subject directly”.In short, emotion is both a result and a cause, and bujin that modifies emotional predicates is always in the causal chain. From the perspective of research methods, when extracting its semantic connotation, we should not only focus on the results but also integrate the antecedents and consequences. This has led to fragmented management and protection of the original integrated terrestrial and marine ecosystems, which contradicts the spirit of coordinated land-sea integration. The Ecological Environment Code currently being compiled in China undoubtedly aims to overcome the shortcomings of the separated land-sea approach in China's ecological protection legal framework, achieving an integrated system for the protection of terrestrial and marine environments. Given the special nature of coastal ecosystems and the fragmented practices and laws governing their protection in China, systematic protection of China's coastlines is an inevitable trend. In this context, discussing how to incorporate coastal protection into the Ecological Environment Code and how to specifically construct provisions and content related to coastal protection within the code becomes an unavoidable issue in the process of codifying the Ecological Environment Code.This paper primarily employs methods such as literature analysis, logical analysis, and normative analysis to reveal that the content of coastal ecological environment protection should be categorized under the norms that bear core environmental law values. Even if it currently exists in separate laws for coastal management, it should be integrated and incorporated into the Ecological Environment Code to maximize its systemic benefits. Then, the paper points out that incorporating coastal ecological protection into the Ecological Protection Part of the Ecological Environment Code requires not only a systematic review of relevant laws and regulations currently in place in China, as well as local legislation concerning coastal protection, but also the legal refinement of new concepts and systems related to coastal protection emerging from China's ecological civilization reform policies and practices. Additionally, within the Marine Ecological Protection Chapter of the Ecological Protection Part, a systematic framework should be established for both general protection of marine ecological elements such as sea areas and islands, and special protection of the marine ecological region known as the coastal zone. Based on these ideas, this paper suggests setting up a dedicated section on Coastal Protection within the Marine Ecological Protection Chapter of the Ecological Protection Part, addressing prominent issues in China's coastal protection and making specific provisions for the particularities of coastal protection.Compared with existing research, this paper makes an expansion in the following two aspects. First, it clarify the categorization of coastal zone protection in the Ecological Environment Code and the framework approach for its inclusion in the Ecological Environment Code. Marine data sharing is not only a key to addressing problems such as marine disasters and resource scarcity but also an essential support for advancing the construction of “Digital Ocean” and the strategy of building a strong maritime country. The Guangdong-Hong Kong-Macao Greater Bay Area, located on the coast of the South China Sea, is endowed with abundant marine resources and extensive maritime areas, and holds an important position in the construction of an ocean power. Marine data sharing is a crucial foundation for the Greater Bay Area to achieve coordinated development of the marine economy, modernization of marine governance, marine ecological protection, and technological innovation. However, as a special region in the framework of “one country, two systems, three legal jurisdictions”, the Guangdong-Hong Kong-Macao Greater Bay Area faces numerous legal and institutional challenges in the process of marine data sharing. This paper employs interdisciplinary research methods, integrating theories and practices from oceanography, law, and data science, to conduct an in-depth analysis of the current status and issues of marine data sharing in the Guangdong-Hong Kong-Macao Greater Bay Area. This paper finds that marine data sharing in the Guangdong-Hong Kong-Macao Greater Bay Area faces challenges such as security risks of sensitive data, governance risks of low-quality data, and privacy risks for marine citizens. Moreover, due to differences in legal culture, interests, and technological levels among the three regions, there are significant legal conflicts in the protection of legal interests, data ownership, and digital law enforcement risks. Additionally, institutional barriers exist in data classification and grading standards, data value assessment systems, and data property rights definitions. To break the “information silos” in the marine governance of the Guangdong-Hong Kong-Macao Greater Bay Area, it is imperative to overcome the barriers to marine data sharing and the inconsistency in the evaluation standards of shared data. The specific legal coordination pathways include: strengthening the top-level institutional design for convenient marine data sharing under the premise of security, clarifying the interests and security elements of marine data sharing among the three regions, and drawing on international experience to promote the facilitation of cross-border data flows; unifying the evaluation and classification standards of marine data value among Guangdong, Hong Kong, and Macao, establishing an independent expert committee, improving the external review mechanism, and supporting a data security accountability system; constructing a legal system for the reuse of marine data in the Guangdong-Hong Kong-Macao Greater Bay Area to meet diverse user needs; and shaping an integrated marine data governance and coordinated supervision system by forming regulatory coordination groups, unifying standards, and building collaborative mechanisms. Marine emerging industries, represented by offshore wind power, have continuously gathered energy and gradually become an important growth pole of China's national economy. Against this background, the development of the offshore wind power industry needs to be upgraded to high-quality development in an orderly manner. However, there is a great lack of studies on empirical research and competitiveness evaluation of the offshore wind power industry in several coastal provinces based on actual data from wind farm projects, especially in terms of industrial evaluation standards and in-depth research on industrial upgrading.This study selects 48 offshore wind farms that have been put into operation in four provinces along the southeast coast of China, namely, Guangdong, Jiangsu, Zhejiang, and Fujian. It uses the China Industrial Enterprise Database, the China Customs Import and Export Enterprise Database, the Ministry of Commerce's Foreign Investment Enterprise (Institution) Directory, and the World Input-Output Database (WIOD). Drawing on the upstream index of Antràs et al. (2012) and Chor et al. (2014), it comprehensively applies the analytic hierarchy process and the TOPSIS entropy method to explore the competitiveness of the offshore wind power industry in the southeast coastal region. Additionally, it analyzes the competitiveness evolution and future development trends of the offshore wind power industry from the aspects of the establishment of the research index system, data processing and analysis, and conclusions and suggestions. Specifically, in the competitiveness evaluation index system of the offshore wind power industry in the southeast coastal provinces, the enterprise development has the highest weight, followed by economic foundation and green output. Among the southeast coastal provinces, Guangdong has the strongest competitiveness in the offshore wind power industry, followed by Jiangsu and Zhejiang.Compared with previous literature, this paper makes the following expansions. First, it explores the theoretical mechanism affecting the competitiveness of the offshore wind power industry and constructs a regional industrial competitiveness evaluation model with five dimensions: economic foundation, enterprise development, technological innovation, resource endowment, and green output. Second, the assessment focuses on calculating the weight of each dimension and measures the evaluation values of wind power projects at the five-dimensional level, empirically analyzing the different result characteristics of the offshore wind power industry in different regions. Third, it puts forward suggestions related to industrial upgrading, such as improving the spatial layout of offshore wind power, expanding domestic and international market demand, promoting the integrated development of the industrial chain, and adhering to leading technological innovation.To a certain extent, this study reveals the internal logic of the evolution and development of China's offshore wind power industry's competitiveness. It helps government bodies deploy relevant offshore wind power industry upgrading policies under the strategic goal of building a strong marine country.
