  • 网络时代的通信秘密:性质、范围及限制

A cross-sectional comparative study and a reality check reveal that correspondence confidentiality not only covers privacy and expressive interests, but also corresponds to the requirement of constructing a communication system that citizens can use safely. Only for this reason, correspondence confidentiality is not a subordinate to the privacy right. In terms of scope, it covers both the content of correspondence and the components of correspondence, but the two are protected to different degrees, and the latter should be strictly determined in the network era.   • 个人信息权绝对权属性的规范依据与法理证成——从微信读书案切入

In the Weread case, the court adopted the view of the legal benefit protection, which presented many logical loopholes and jurisprudential flaws in the understanding of personal information, indicating that the clarification is necessary. Combined with the relevant contents of the Personal Information Protection Law and the structure of the personality rights part in Civil Code, the rights protection theory is clearly based on the legal norms, and the jurisprudential proof will further confirm the absolute right attribute of personal information: the identifiability can delineate the basic scope of personal information, making the object of the right relatively certain and the boundary of the right relatively clear; while on the premise that private information is classified as privacy to be protected by absolute right, the fact that non-private information cannot be protected by absolute right is hard to be proofed in terms of both legal basis and system coordination, and the content of the right to personal information is also reflected in the limited self-determination of personal information; The results show that leverage ratio has an inverted U-shaped influence on enterprise upgrading through innovation ability, operation efficiency and risk-taking channels, that is, there is a “stepping stone effect” of moderate promotion and a “stumbling block effect” of excessive inhibition, and there is no obvious difference between enterprises and leverage structure heterogeneity. At the same time, the result of deleveraging pressure shows that most of the manufacturing listed companies in China still have room to increase leverage, thus enabling enterprises to upgrade. However, there are also a small number of enterprises with high leverage ratio, and the pressure of deleveraging is prominent; among them, the deleveraging pressure of state-owned enterprises is significantly greater than that of private enterprises, and the deleveraging pressure of long-term debt and commercial credit loans of enterprises is significantly less than that of short-term debt and bank loans. And the paper is empirically tested by using Chinese provincial panel data from 2004 to 2017. The study found that the “bringing in” technology spillover significantly promoted the high-end of my country's manufacturing value chain, while the “going out” reverse technology spillover did not show significant enthusiasm. The two strategies show significant regional heterogeneity in the high-end climb of the manufacturing value chain. Through the threshold regression, it is found that the “bringing in” technology spillover shows a first increasing and then decreasing influence on the rise of the manufacturing value chain under the threshold characteristic of R&D capability, while the “going out” technology spillover shows a first decreasing and then increasing influence; Similarly, under the threshold characteristics of industrial agglomeration, two-way technology spillovers have a monotonically decreasing influence on the rise of the manufacturing value chain.   • 产业联盟网络中企业5G技术扩散的仿真研究——以扎根理论分析为基础

Based on expert interviews and grounded theory, this paper deconstructs the relevant research variables of 5G enterprise technology diffusion, and finally obtains 23 concepts in 6 categories, which have passed the theoretical saturation test. Subsequently, VensimPLE7.3 software is used to construct the causal diagram based on the 23 concepts obtained from the grounded theory and the realistic relationship in line with system dynamics. Then, according to the data from 1997 to 2006, the system dynamics simulation model of 5G technology diffusion is constructed based on the industrial alliance network, and the simulation results from 2021 to 2035 are obtained. The conclusions are showed as follows: After the observation value of “industrial knowledge (spatial) structure” reaches the extreme value and drops rapidly, the new technology diffusion effect will attract more enterprises to enter the technology industry alliance and carry out applied technology cooperation at a higher rate, which will promote a virtuous circle between the continuously improving “5G industrial technical standards” and the “transformation mechanism of technological innovation achievements” in the industrial alliance, and then continuously improve the “output value of new technology products” and attract more application-oriented technological innovation enterprises to enter the industrial alliance. The “four-stage” model of 5G technology diffusion in industrial alliance network can be obtained by theoretical construction of the dynamic performance of this simulation conclusion. Combined with the simulation visualization results, taking 2021-2035 as a unit of life cycle, 2021-2024 is the discrete interactive stage of technology, 2024-2026 is the single-core diffusion stage of technology, 2026-2029 is the multi-core diffusion stage of technology, and 2029-2035 is the high-level interactive communication stage of technology. Family strategy depends not only on the strength of family resource endowment, but also on the positioning of family goal. Based on the perspective of family strategy, this paper analyzes the shaping mechanism of farmer's family education view from two dimensions, namely family resource endowment and family goal. The family resource endowment lays the economic foundation of the farmer's education investment, while the family goal orientation shapes the power of the farmer's family education investment. On the whole, the rural areas in Jiangsu and Zhejiang regions have strong resource endowment due to their local markets as a distinct location advantage, and the development-oriented family goal further strengthens the power of education investment. In the Southwest China, farmers' families have limited resource endowment, and the maintenance orientation of family goals weakens the motivation of farmers' investment in education. Peasant families generally pay less attention to the education of their children and tend to adopt the strategy of selective investment. Education is an effective way to realize the development and upward social mobility of peasant families. To enhance the Chinese cultural identity of overseas Chinese, improve the ecology of overseas Chinese education and continue the feudal rule, the consuls in Southeast Asia were committed to promoting the prosperity of overseas Chinese education. Through these efforts, consular protection has made outstanding contributions, including improving the education ecology and cultural self-confidence of overseas Chinese in Southeast Asia, enriching the connotation of the modern Chinese consular protection mechanism and laying foundations for the development of China's consular protection system.
