Based on the development level and trend of AI technology, the criminal law needs to establish a correct and rational attitude to dealing with the hidden criminal risks. There is an essential difference between the dedicated AI and the general AI. At this stage, the criminal law should pay more attention to the control of criminal risks that are generated around dedicated AI and show self-restraint on the possible general AI in the future. The most transformative impact of dedicated artificial intelligence lies in the advancement of a comprehensive integration of the network and reality. The internal risk of dedicated AI is most likely to arise around massive data and intelligent algorithms. And its external risks are the abuse of AI technology and security threats that the internal risks may transform into real dangers. In this regard, the criminal law should strictly follow the principle of legality and show self-restraint to strengthen the protection of data security so that it will realize the control of AI from design to application.
