There are following problems about current land acquisition compensation allocation system: the low compensation standard; failure to clarify how to compensate for the right to use the homestead; failure to clarify how to compensate for contract management right; no model law guiding how to distribute benefits of rural economic collectives. The reform of the compensation system for farmland expropriation in China should adhere to the value concept of “benefits shared by all participants” and “the advantages of collective property rights governance”. The government should substantially increase the compensation ratio. Legislation should clarify how to compensate land contractual management rights and homestead use rights.
