At the present, there are still differences in the theoretical understanding of the special legal person of rural collective economic organizations, and it is urgent to clarify the legal principle, which is a prerequisite for ensuring the smooth progress of its legislation. There is an urgent need to reach the following consensus: 1) rural collective economic organizations should not be positioned as the main body of collective ownership; 2) the establishment of special legal persons in rural collective economic organizations should not require farmers' capital as a necessary condition; 3) members of rural collective economic organizations include but are not limited to farmers' collective members; 4) the termination of special legal persons of rural collective economic organizations does not affect the legal status of farmers' collective ownership.
