The credit punishment in private law is initiated by market subjects in the field of non-public administration, especially in the market. It is the origin of current social credit punishment, and also an organic part of the current social credit system. The basic form of credit punishment in private law is to deny the transaction opportunity to the faithless or to increase the transaction cost of the faithless. Its basic structures are the motive of transaction risk avoidance, credit information and marketization organization mechanism of judging transaction risk. Credit punishment in private law is not a legal punishment, which does not aim at cracking down on acts violating good faith, and it belongs to social sanctions. Its logic reveals us that the core of credit mechanism in the market is the construction of credit information mechanism rather than the construction of credit punishment mechanism.
