This is not just a doctrinal argument. The EU has clearly mentioned the concept of “security principle” as early as in the Draft Common Frame of Reference. Differing from the traditional basic principles of civil law, such as the principle of equality and the principle of voluntariness, the principle of security is a framework functional principle with legal interests of security as its core.
