The issue of data ownership has become a common problem faced by domestic and foreign scholars. In theory, there are different ways to confirm rights, such as property rights, intellectual property rights, and de facto property, but they are difficult to conform to the current changes in the logic of digital economy governance. The new type of data property rights is not an absolute right, but it should be limited. The realization of individual subject interests should be integrated into the system design, and the governance path of risk management should be adopted to respond to the problems of data competition and insufficient innovation. Combining the above dimensions, it is theoretically appropriate to construct a data control right with moderate exclusivity, which includes rights, such as control, access, portability, and erasure, as the middle link in the property right spectrum. Our data legislation should avoid applying a single data property right.
