The interpretation of the data holder's rights should be based on the current legal framework. The control of data and possession of things are theoretically the same in the normative sense, and the control of data is acquired by obtaining the actual control of the data. Data controllers can be protected by applying the norm of legal protection of possession. The legality of data collection is a prerequisite for the data holder to gain the legal position to exercise control over the thing. The elements of the position are the capacity to retrieve data at will and the intention of possession. During data sharing, intrusion, sharing and evasion of data access are manifested as unlawful interference with possession. Data holders have the right of claims of possession's protection, which protects the factual state and makes data transactions possible.
