While considering the changes in the substantive functions of the platform, it is essential to review the existing network copyright system. This is to determine how to effectively achieve a balance of interests among all parties involved in the network disk service, ensuring protection of works and their legal dissemination and utilization.By analyzing the technical characteristics of the network disk platform and the nature of its service, and examining typical judicial cases of copyright infringement both domestically and internationally, this paper underscores that the platform's liability should vary with its capacity to influence user behaviors and the prevailing conditions. It is practically demonstratedthat functions of the network disk platform are predominantly under the control of its users, and the platform cannot dictate user actions. Even if the platform facilitates certain technologies and services, it doesn't change the user's control status over their data. Therefore, the network disk platform should be recognized as a network service provider rather than a network content provider. After analyzing the principle of “technology neutrality” in the copyright protection system, this paper further proposes that the platform should still fulfill its copyright protection obligations based on the “notice deletion” rule and the red flag principle, considering the nature of the platform subject, the pattern of infringement and the platform's performance capacity. Concurrently, after analyzing the evolving trends of the digital economy and the value of network disk services, this paper posits that the obligations and responsibilities set for network disk platforms should not stray from public policy considerations. Expanding the rights of copyright holders merely to curb specific intentional infringements could upset the present balance of rights and duties among all stakeholders.Compared with the previous literature, this paper makes extension in the following aspects: First, penetrating the appearance of the network disk platform innovation service, analyzing the realization of its function, the underlying technical logic of the service. Despite the continuous emergence of innovative applications, as long as the technical essence of these new applications and service models remains unchanged, the analytical framework of this paper can still be applied. Secondly, diverging from the viewpoint that promotes the creation of new concepts and the establishment of new legal systems to accommodate the evolution of innovative services, this paper contends that existing institutional designs, once have been proven mature and effective, should be upheld in the absence of significant reshuffling in interests pattern. When leveraging new technologies to bolster platform compliance and better realize its obligations, priority should be given to ensuring the protection of rights and interests of all stakeholders within the current value paradigms and institutional structures, rather than impulsively disrupting the established system. The research in this paper provides an effective way to analyze the relationship between technological innovation, institutional innovation and the change of rights and obligations, and can also be used as a reference for the research on the liability identification and obligation undertaking of network service providers in other fields.
