In the era of the Civil Code, civil law scholars should pay more attention to the judicial practice and the actual law application, so that the wisdom of scholars and practitioners could get together to promote the effect of law. From the perspective of judicial protection, the judicial practice has formed a clear idea of applying Article 995 of the Civil Code or the relevant provisions of the Tort Liability Book separately to different claim items, defining the rights with the provisions of specific personality rights, and realizing the Judicial Lawmaking with the provisions of general personality rights, which has a theoretical basis.
