It plays an irreplaceable role on protecting the legal rights and interests of the minors in the abnormal marriage families especially in the divorced families. At the beginning of the implementation of the Marriage and Family Book of our Civil Code, we should refer to the practical situation in China to find out the defects of the judicial difficulties of the visitation right, change the legislative purpose based on parental right, and set the legislative purpose of the “Best Interests of the Child” to break the bottleneck of the current visitation right system.
